Abstract
Description
The victims crime of trafficking persons in marriage are experienced by women. Therefore, victims must get maximum protection. The purpose of this research is to identify and explain and analyze the decision no. 264/Pid.Sus/2021/PN Mjk. The type of research is normative juridical using a statue approach and a case approach, sources of primary and secondary legal materials and deductive analysis. The application of Decision 264/Pid.Sus/20201PN Mjk isn't in accordance with Law no.21 of 2007 concerning the Eradication of Crime Trafficking in Persons and Law no.1 of 1974 concerning marriage. With judges making factual judgments in court. however, both in terms of substance and the form of the test arn't in accordance with the applicable regulations. In this case the defendant was sentenced to 1 (one) year in prison. The benefit of this research is that the public knows and gets an explanation regarding the analysis of decision Number 264/Pid.Sus/2021/PN Mjk.
